1. About us

These services are provided by Compass Visuals (ABN 12 345 678 901), a photography studio offering portrait, engagement, family, sport and childcare-centre sessions. You can contact us at hello@compassvisuals.com.au or 0400 000 000.

2. Our services

We provide photography sessions and related services as described on our website and as agreed with you. Details such as session length, inclusions, locations and deliverables will be confirmed with you before your session. Sample images on our website are illustrative of our style; every session is unique and outcomes naturally vary.

3. Bookings and booking fees

To secure a session date, we require payment of a booking fee. The booking fee:

• reserves your chosen date and time;
• is payable at the time of booking via our secure payment provider; and
• is non-refundable if you later cancel, except where you are entitled to a remedy under the Australian Consumer Law (see clause 8).

Your booking is confirmed only once the booking fee is received and we have acknowledged it. Any remaining balance for your session is payable as advised before or on the session date, unless otherwise agreed in writing.

4. Prices and payment

All prices are in Australian dollars (AUD) and include GST where applicable. Payments are processed securely by our payment provider (Stripe); we do not store your full card details. We will issue a receipt for each payment and a tax invoice where required.

5. Rescheduling, cancellations and no-shows

If you reschedule or cancel

If you need to reschedule, please give us as much notice as possible and we will do our best to find a new time. Where we can reasonably accommodate a reschedule, your booking fee may be transferred to the new date. If you cancel, the booking fee is non-refundable as set out in clause 3.

No-shows and lateness

If you do not attend a scheduled session without notice, the booking fee is forfeited. If you arrive late, the session may be shortened so as not to affect other bookings.

Weather and circumstances beyond control

For outdoor sessions affected by weather, or where events beyond either party’s reasonable control prevent the session, we will work with you to reschedule at no additional booking fee.

6. Your consumer guarantees

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Among other things, we must provide our services with due care and skill, fit for any purpose you told us about, and within a reasonable time. If we fail to meet a consumer guarantee, you may be entitled to a remedy. For a major failure you may be entitled to cancel and obtain a refund for the unused portion, and to compensation for reasonably foreseeable loss or damage.

7. If we need to cancel

In the unlikely event that we must cancel your session (for example, due to illness or equipment failure) and cannot provide a suitable alternative photographer or date, we will refund your booking fee and any amounts paid for services not provided. Our liability in these circumstances is otherwise limited as set out in clause 11.

8. Refunds

Booking fees and payments are non-refundable for change of mind. You are entitled to a refund or other remedy where required by the Australian Consumer Law — for example, where there has been a major failure to meet a consumer guarantee. This does not limit any other rights you have at law.

9. Copyright and use of images

Unless otherwise agreed in writing, Compass Visuals retains copyright in all photographs we create, in accordance with the Copyright Act 1968 (Cth).

Your licence

On full payment for your session and images, we grant you a non-exclusive, non-transferable licence to use the delivered images for your personal, non-commercial use — including printing, sharing with family and friends, and personal social media. You must not sell the images, enter them into competitions as your own, or use them for commercial purposes without our written permission. Please do not substantially edit, crop or apply filters that alter the integrity of the images, consistent with our moral rights under the Copyright Act.

Our use of images

We may wish to use selected images from your session in our portfolio, website, social media or other marketing. We will only do so with your consent, as described in our Privacy Policy. You can decline or withdraw that consent for future use at any time.

10. People in photographs and conduct

You confirm that you have the authority to agree to photography for everyone you bring to a session (including children for whom you are a parent or guardian). You agree to treat us and any assistants with respect; we may end a session if anyone’s behaviour is unsafe, threatening or unlawful, in which case fees paid are not refundable.

11. Liability

Nothing in these Terms limits your rights under the Australian Consumer Law. To the extent permitted by law, and where a consumer guarantee applies, our liability for failure to comply with that guarantee is limited (at our option) to re-supplying the services or paying the cost of having them re-supplied. To the extent permitted by law, we are not liable for indirect or consequential loss, and our total liability is limited to the amount you paid for the relevant session.

12. Privacy

We handle your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). Please read it to understand how we collect, use and protect your information.

13. Use of this website

You may use this website for lawful purposes only. You must not interfere with the site’s operation, attempt to gain unauthorised access, or copy, scrape or reproduce its content (including images) without our permission. Website content is provided in good faith and may change without notice.

14. Changes to these Terms

We may update these Terms from time to time. The version that applies to your booking is the version published on this page at the time you book. The current version is always available here, with the “last updated” date shown above.

15. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that state and the Commonwealth of Australia.
